Platform Terms & Conditions of Use

1. About the Platform

Welcome to Paysecure (the "Platform"). The Platform facilitates interactions between:

  • Buyers (the "Receiver"); and

  • Sellers (the "Provider"),

making it easier for the Receiver and the Provider to plan, communicate, arrange payment and deliver the services in a fast and secure manner (the "Services").

The Platform is operated by Paysecure Pty Ltd (ACN 637 354 217). Access to and use of the Platform, or any of its associated products or Services, is provided by Paysecure. Please read these terms and conditions (the "Terms") carefully. By using, browsing and/or reading the Platform, this signifies that you have read, understood and agree to be bound by the Terms. If you do not agree with the Terms, you must cease usage of the Platform, or any of its products or Services, immediately.

Paysecure reserves the right to review and change any of the Terms by updating this page at its sole discretion. When Paysecure updates the Terms, it will use reasonable endeavours to provide you with notice of updates of the Terms. Any changes to the Terms take immediate effect from the date of their publication. Before you continue, we recommend you keep a copy of the Terms for your records.

2. Acceptance of the Terms

You accept the Terms by registering for the Services and/or making any payment as required under the Terms for use of the Services. You may also accept the Terms by clicking to accept or agree to the Terms where and if this option is made available to you by PaySecure in the user interface.

3. The Services

In order to access the Services, both the Receiver and the Provider are required to register for an account through the Platform (the "Account").

As part of the registration process, or as part of your continued use of the Services, you may be required to provide personal information about yourself (such as identification or contact details), including:

  • Email address

  • Preferred username

  • Mailing address

  • Telephone number

  • Password

  • Driver’s licence, passport, or other form of photo ID

You warrant that any information you give to Paysecure in the course of completing the registration process will always be accurate, correct and up to date.

Once you have completed the registration process, you will be a registered member of the Platform ("User") and agree to be bound by the Terms.

You may not use the Services and may not accept the Terms if:

  • you are not of legal age to form a binding contract with Paysecure; or

  • you are a person barred from receiving the Services under the laws of Australia or other countries including the country in which you are resident or from which you use the Services.

4. Your Obligations as a User

4.1. As a User, you agree to:

  • Not share your login with any other person;

  • Use the Services only for purposes that are permitted by the Terms and applicable law;

  • Maintain confidentiality of your password and email address, and notify PaySecure of any breach;

  • Not impersonate another user or use another account;

  • Ensure Your Content is accurate, lawful, and up to date;

  • Not harass, impersonate, stalk, or threaten another user;

  • Use the Platform only for lawful purposes;

  • Not use the Platform to collect data for spam or unsolicited contact;

  • Accept that commercial advertising, affiliate links, and solicitation are prohibited unless approved;

  • Acknowledge that automated use of the Platform is prohibited.

5. Using the Platform

As the Receiver:

  • Create or accept payment agreements

  • Pay milestone deposits prior to delivery

  • Approve release of deposits upon delivery

As the Provider:

  • Create or accept payment agreements

  • Deliver agreed products or services after receiving a deposit

  • Request release of deposits upon milestone completion

6. Payment

By using the Platform, you agree:

  • To pay all fees associated with each agreement

  • That payments are processed using Zepto

  • That you have read and agreed to Zepto' terms and policies at https://zepto.com.au/website-terms & https://zepto.com.au/legal-and-privacy-policy

7. Refund Policy

Paysecure does not hold liability to the Receiver and will not issue direct refunds.

If a Receiver is unsatisfied:

  • Contact the Provider directly

  • Use the Platform’s dispute and refund features

  • If unresolved after 14 days, contact Paysecure Support

Providers must:

  • Respond via the Platform dispute process

  • If unresolved after 14 days, contact Paysecure Support

  • Instruct PaySecure to refund if agreed

Receivers and Providers agree to comply with this Refund Policy.

8. Copyright and Intellectual Property

All materials on the Platform are subject to copyright and intellectual property rights owned or licensed by Paysecure. You are granted a limited, non-exclusive license to use the Platform.

You may not republish, adapt, or commercially exploit materials from the Platform without prior written consent.

Where you upload Your Content, you grant PaySecure a worldwide, royalty-free licence to use, adapt, and share Your Content for operational purposes.

9. Privacy

Paysecure takes your privacy seriously. We are committed to complying with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

9.1 What We Collect

  • Name, email, phone, and address

  • ID documents

  • Payment information (processed by third parties)

  • IP address and usage data

9.2 How We Use It

  • To verify identity

  • Facilitate payment flows

  • Communicate with users

  • Fulfil legal obligations

  • Improve security and user experience

9.3 How We Share It

  • With payment and ID verification partners

  • With regulators where legally required

  • Internally with staff and contractors on a need-to-know basis

We do not sell your data.

9.4 Storage, Security and Retention

  • Data is securely stored in encrypted environments

  • Access is role-based and protected by MFA and security protocols

  • We retain only what is needed and delete or anonymise when no longer required

9.5 Your Rights

You may access, correct, or request deletion of your data, subject to legal obligations.

10. General Disclaimer

Paysecure excludes all warranties not expressly included, and limits liability as allowed by law. Use of the Platform is at your own risk.

11. Limitation of Liability

Paysecure's total liability is limited to resupplying the Services. We are not liable for indirect, special or consequential loss.

12. Termination

You may terminate by cancelling your account (if you have no outstanding agreements).

Paysecure may terminate access if:

  • You breach the Terms

  • It is required by law

  • The Platform is no longer viable

  • You impact PaySecure’s reputation or operations

13. Indemnity

You agree to indemnify Paysecure for any losses, costs or claims arising from your use of the Platform or breach of the Terms.

14. Dispute Resolution

Disputes must follow these steps before legal action:

  • Provide written notice outlining the dispute

  • Attempt good-faith resolution within 30 days

  • If unresolved in 60 days, appoint a mediator

  • If mediation fails after 120 days, either party may terminate mediation

Mediation takes place in NSW, Australia.

15. Governing Law and Venue

These Terms are governed by the laws of New South Wales. All disputes must be resolved in NSW courts.

16. Independent Legal Advice

Each party confirms they had the opportunity to seek independent legal advice and agree these Terms are reasonable.

17. Severance

If any clause is unenforceable, the rest of the Terms remain in effect.
